Photo Session Terms and Conditions

Session Details

Time and date of session

Time and date of session will be agreed upon by Photographer and client following prior to any meetings taking place. A prompt arrival is appreciated! If you expect you will be late to your session, please let me know by calling or texting me at 587-815-8562. Please note that your session may have to be cancelled or rescheduled if you are more than 15 minutes late.

Session location and duration

All sessions take place at my downtown Red Deer studio, 4920 Gaetz Avenue, 2nd floor. Custom session duration is 4 hours, mini sessions typically last 1 hour.

Session fee and inclusions

Session fee is variable and based on session type. Custom session fees include a product credit that will be set out and communicated to you prior to booking. Custom session fees do not include images. Images (in any form, be it digital or physical) and products are sold separately.

Fees for mini sessions typically include your session plus a specified number of digital images. Specific details will be communicated prior to your booking based on the session type you choose.

Deliverables and timeline

All purchased images are delivered as both high resolution JPEG files and in whatever printed form you have chosen. Timeline for delivery of digital images is 2 weeks, with physical products arriving in 4-6 weeks from your session date. Delivery of images in any form may be held until payment is processed.

Copyright and usage rights

Photographer retains copyright of all images created. Client receives non-exclusive license for personal, non-commercial use of delivered images. Client may share on social media, create prints for personal display, and share with family/friends. Client may not use images for commercial purposes, resell images, or remove watermarks/credits. Commercial use license may be negotiated for additional fee.

Model release

Clients will be asked to sign a model release upon completion of their session. Client retains the right to refuse, or to specify which images or image types can be used and for what purpose.

Payment terms and cancellations

Payment terms

Payment of session fee is required to book your session date. Dates are usually held for 24 hours without payment, at which time they will be released for booking by other clients. Payment for images, prints, artworks, albums, etc. must be made at the time of your image reveal and ordering appointment unless otherwise arranged (e.g. in the case of a specified recurring payment plan).

Refundable deposits

Where specified, a refundable deposit may be charged in place of a session fee. This deposit will be refunded back to you on completion of your session, or converted to product credit. Product credit can be applied toward any product of your choice.

GST

All services and products provided are subject to GST.

Accepted forms of payment

Payments can be made by cash, e-transfer, credit card, or Affirm (buy now pay later, requires application through Affirm website). Payment plans may be available on a case by case basis.

Payment plans

Payment plans may be arranged at the conclusion of your image reveal and ordering appointment on a case by case basis. Credit card must be provided and will be kept on file to be charged monthly for the agreed upon duration of the plan on the agreed upon date. Artwork will be ordered upon completion of final payment.

Cancellation and rescheduling policy/fees

A one time rescheduling of your portrait session is allowed. You must let us know at least 3 weeks before your session if you do need to reschedule, so we can make your date available to others.

If the minimum of three weeks notice to reschedule your session has not been provided, a reschedule fee of $200 may be required to reschedule your photo session.

The portrait consultation is mandatory for every portrait session. You can reschedule your portrait consultation once with 1 day notice.

Photographer cancellation

If the photographer cannot attend your session, every effort will be made to inform you with plenty of advanced notice. Your session will be rescheduled to a mutually agreeable date. In the event a mutually agreeable date cannot be arranged, you will be refunded any monies paid and your session will be cancelled.

Additional Fees

Additional fees may apply, including but not limited to:

• Setup

• Rush editing or additional requested editing

Limitation of Liability

In the unlikely event of total photographic failure, Photographer’s liability is limited to a refund of amounts paid under this contract. Photographer is not liable for indirect, consequential, or special damages including but not limited to lost wages, travel expenses, or emotional distress.
